Terms of Service

1. Acceptance of Terms

By accessing or using freshstartwellness.cc (the "Site") or submitting an intake form, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, do not use the Site.

2. Description of Service

FreshStart Wellness operates the Site as a consumer intake and referral service. We connect households with independent third-party partner organizations that provide at-home COVID-19 screening programs and stop-smoking / smoking cessation programs. FreshStart Wellness is not a laboratory, clinic, pharmacy, medical provider, or cessation counselor. We do not perform testing, issue results, dispense medication or nicotine replacement products, or provide medical advice, diagnosis, treatment, or counseling. All programs, products, and services are delivered by independent partner organizations under their own terms and policies.

3. No Medical Advice

Nothing on the Site constitutes medical advice. The information on the Site is provided for general informational purposes only and is not a substitute for professional medical advice, diagnosis, or treatment. Always consult a qualified healthcare provider about any medical condition or treatment decision.

4. Eligibility

You must be at least 18 years old and a resident of the United States to use the Site or submit an intake form. By using the Site, you represent that you meet these requirements.

5. Your Representations When Submitting a Form

When you submit an intake form, you represent and warrant that:

  • The information you provide is true, accurate, current, and complete.
  • The telephone number and email address you provide belong to you or you have the authority to provide them.
  • You are the person identified on the form, and you are submitting it on your own behalf.
  • You understand that submission is not a request for medical care or an order for any product.

6. Consent to Be Contacted

By submitting an intake form, you provide your electronic signature and express written consent to be contacted by FreshStart Wellness and its marketing partners, affiliates, and service providers at the telephone number and email address you provide — including via automated telephone dialing systems, artificial or prerecorded voice messages, SMS/text messages, and email — regarding at-home COVID-19 screening programs, stop-smoking programs, and related services, even if your number appears on any federal or state Do-Not-Call list. Consent is not a condition of any purchase. Message and data rates may apply. You may revoke consent at any time as described in our Privacy Policy.

7. How Your Information May Have Reached Us

Contact information used to reach you may have originated from (a) a form you submitted on the Site, (b) a form you submitted on an affiliate, lead provider, or co-registration partner's website, (c) cookie-based identification across our partner network, or (d) cookie-less device and browser fingerprinting matched against partner databases of individuals who previously consented to be contacted about these programs. Our Privacy Policy explains each of these sources in detail and describes how to opt out.

8. Prohibited Conduct

You agree not to:

  • Submit false, misleading, or inaccurate information.
  • Use the Site to impersonate any person or entity.
  • Attempt to gain unauthorized access to the Site, its servers, or any associated systems.
  • Use any automated means to access or submit information to the Site.
  • Interfere with or disrupt the Site or the servers or networks connected to it.
  • Use the Site in violation of any law or regulation.

9. Intellectual Property

All content on the Site — including text, graphics, logos, images, and the arrangement thereof — is owned by or licensed to FreshStart Wellness and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or create derivative works without our prior written permission.

10. Third-Party Partners

The Site connects you with independent third-party partner organizations. FreshStart Wellness does not control, endorse, or assume responsibility for the products, services, content, pricing, practices, or policies of any partner. Your interactions with partners are solely between you and the partner, and are governed by the partner's own terms and privacy policies.

11. Disclaimers

THE SITE AND ALL CONTENT, SERVICES, AND REFERRALS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY. FRESHSTART WELLNESS MAKES NO REPRESENTATION OR WARRANTY THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY PARTNER PROGRAM WILL BE SUITABLE OR AVAILABLE FOR YOU.

12. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, FRESHSTART WELLNESS AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR USE OF THE SITE, ANY PARTNER PROGRAM, OR THESE TERMS. IN NO EVENT WILL OUR AGGREGATE LIABILITY EXCEED ONE HUNDRED U.S. DOLLARS ($100).

13. Indemnification

You agree to indemnify, defend, and hold harmless FreshStart Wellness and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or relating to your use of the Site, your submission of information to us, or your violation of these Terms.

14. Governing Law

These Terms are governed by the laws of the State of Delaware, without regard to its conflict of laws principles. Any dispute arising out of or relating to these Terms or the Site will be resolved exclusively in the state or federal courts located in Delaware, and you consent to the jurisdiction of those courts.

15. Changes to These Terms

We may update these Terms from time to time. When we do, we will update the Effective Date above. Your continued use of the Site after changes become effective constitutes your acceptance of the revised Terms.
